This GDPR Notice applies to individuals located in the European Union (EU), European Economic Area (EEA), or the United Kingdom (UK) who interact with Calle Foster Coaching & Consulting ("CFC," "we," "us," or "our") through our website at www.CalleFoster.com or through our services.

This notice supplements our Privacy Policy and explains your specific rights under the General Data Protection Regulation (GDPR) and, where applicable, the UK GDPR.

1. Data Controller

The data controller responsible for your personal data is:

As a US-based business, CFC operates primarily in the United States. If you're engaging with us from the EU, EEA, or UK, we process your data in accordance with GDPR requirements.

2. What Personal Data We Collect

We collect the following categories of personal data:

  • Contact information: name, email address, phone number

  • Professional information: job title, employer, career goals shared in inquiry forms or coaching conversations

  • Technical data: IP address, browser type, device type, and website interaction data collected via Google Analytics and Microsoft Clarity

  • Communication data: emails, messages, and information you share with us voluntarily

We do not collect sensitive personal data (such as health information, racial or ethnic origin, or financial account details) and we do not use automated decision-making or profiling that produces legal or similarly significant effects.

3. Legal Basis for Processing

We only process your personal data when we have a lawful basis to do so. Depending on the situation, we rely on the following:

Contractual Necessity

When you engage in a coaching program or service with us, we process your data because it's necessary to deliver that service and fulfill our agreement with you.

Legitimate Interests

We use website analytics (Google Analytics and Microsoft Clarity) based on our legitimate interest in understanding how our website is used so we can improve it. We balance this against your interests and fundamental rights.

Consent

When you subscribe to our newsletter or opt into email communications, we process your data based on your explicit consent. You can withdraw that consent at any time by unsubscribing via the link in any email or by contacting us directly.

Legal Obligation

We may process your data where necessary to comply with a legal obligation.

4. How Long We Keep Your Data

We keep your data for as long as necessary to fulfill the purposes outlined in this notice, including:

  • Client data: retained for the duration of the coaching relationship and for up to 5 years afterward for business record-keeping purposes

  • Newsletter subscribers: retained until you unsubscribe or request deletion

  • Website analytics data: retained according to the default retention periods set by Google Analytics and Microsoft Clarity

Once data is no longer needed, we delete or anonymize it.

5. International Data Transfers

CFC is based in the United States, which is outside the EU/EEA. When we collect personal data from EU/EEA/UK residents, that data is transferred to and processed in the US.

The third-party tools we use, including Kit, HoneyBook, Google Analytics, Microsoft Clarity, and Squarespace, also process data in the US or other countries outside the EU. Where required, these providers have implemented appropriate safeguards such as Standard Contractual Clauses (SCCs) or are subject to adequacy decisions.

By submitting your information to us, you acknowledge that your data will be processed in the US.

6. Your Rights Under GDPR

If you're located in the EU, EEA, or UK, you have the following rights regarding your personal data:

Right to Access

You can request a copy of the personal data we hold about you.

Right to Rectification

If any of your data is inaccurate or incomplete, you can ask us to correct it.

Right to Erasure (Right to Be Forgotten)

You can request that we delete your personal data, subject to certain legal exceptions.

Right to Restrict Processing

You can ask us to limit how we use your data in certain circumstances.

Right to Data Portability

Where we process your data based on consent or contract, you can request a copy of your data in a structured, machine-readable format.

Right to Object

You can object to processing based on legitimate interests. We'll stop unless we have compelling legitimate grounds that override your interests or the processing is necessary for legal claims.

Right to Withdraw Consent

Where we process your data based on consent (such as email subscriptions), you can withdraw that consent at any time. Withdrawing consent doesn't affect the lawfulness of processing that happened before you withdrew it.

7. How to Exercise Your Rights

To exercise any of the rights listed above, email us at coaching@callefoster.com with "GDPR Request" in the subject line. We'll respond within 30 days. We may need to verify your identity before processing your request.

9. Right to Lodge a Complaint

If you believe we've handled your personal data in violation of GDPR, you have the right to lodge a complaint with your local data protection authority. In the UK, that's the Information Commissioner's Office (ICO) at ico.org.uk. EU residents should contact the relevant supervisory authority in their member state.

We'd always prefer to resolve any concerns directly, so we encourage you to reach out to us first at coaching@callefoster.com.
